JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 09.03.2022, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 90 litre of liquor in a plastic bag being carried by the petitioner on motorcycle. The learned counsel for the petitioner submits that petitioner has been falsely implicated. Nothing was recovered from his possession. He was mere a passer-by, who came to be

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kursakanta (Sonamani Godown) P. S. Case No.52 of 2022.

The application stands allowed.
