2. Petitioner apprehends arrest in a case registered for the offence punishable under section 190, 191 ( 2 ), 191(3) and 109 of the BNS.
3 . As per the prosecution case , informant, namely Ashish Prakash, alleged that he received a call from his friends that a fight between 15-20 unknown accused persons near Diamond Hotel was going on and insisted him to come to the place of occurrence , and upon such information , when informant went to the spot, accused persons fired upon him, due to which one bullet hit the left side of his neck and other on his hydrocele as a result of which he sustained firearm injury and is undergoing treatment.

4. Learned counsel for the petitioner submits that petitioner is not named In the F.I.R. The name of petitioner transpire during course of investigation . No incriminating article has been recovered from the conscious possession of this petitioner. Petitioner claims clean antecedent. 5 . Learned counsel for the State opposes the prayer for bail and submits that during course of investigation , it has come that this petitioner opened fire upon informant due to which informant sustained fire arm injury .
6. Considering the material available on record and the fact that petitioner is alleged to have caused firearms injury to the informant, prayer for pre-arrest bail of the petitioner is rejected.
