Petitioner seeks bail in a case registered under Sections 302, 120B/34 of Indian Penal Code.

It is submitted that the petitioner has been implicated in this case even though he is in custody since 01.01.2016. It is further submitted that the allegations made in the first information report are doubtful inasmuch as the occurrence had occurred at 1 am but information with the police has been lodged at 4 pm. As regards the cases pending against him, it is submitted that the petitioner has been falsely implicated subsequently on his arrest on 01.01.2016.

Petitioner is in custody in connection with the trial

Patna High Court Cr.Misc. No.61904 of 2017 (3) dt.17-02-2018 2/2 regarding murder of the father of the informant and husband of the deceased. The allegation is of criminal conspiracy made from behind the bars. The other witnesses have also supported the case of the petitioner.

Considering the above mentioned circumstances as also criminal antecedent of the petitioner, this Court is not inclined to grant bail to the petitioner for the present. Prayer is rejected. (Madhuresh Prasad, J) M.E.H./- U T
