JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 27-07-2026 Heard learned counsel for the petitioner and learned APP for the State. Despite valid issuance of notice, none appears for the opposite party No.2.

From perusal of the record, it appears that notice was issued to opposite party No.2 and petitioner was enlarged on provisional bail for a period of 10 weeks in connection with POCSO Case No. 118 of 2024 arising out of Kako P.S. Case No. 234 of 2024 instituted for the offence under Sections 126(2), 76, 303(2), 352, 351(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023, Sections 8 & 12 of the POCSO Act and Sections 66(E), (B) of the I.T. Act.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.17570 of 2026(3) dt.27-07-2026 2/2 that the petitioner was in custody since 2011.2025 and he is enlarged on provisional bail vide aforesaid order. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner mainly submits that there is delay of ten (10) days in lodging the FIR. It is lastly submitted that charge sheet is submitted in this case under Sections 126(2), 75(2), 76, 352, 351(3) & 3(5) of the Bharatiya Nyaya Sanhita, 2023, Sections 8 & 12 of the POCSO Act and Sections 66(E), (B) of the I.T. Act.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, provisional bail granted to the petitioner vide order dated 24.04.2026 in connection with POCSO Case No. 118 of 2024 arising out of Kako P.S. Case No. 234 of 2024 is hereby confirmed.
