The learned counsel for the petitioner arguing vehemently for sometime seeks permission to withdraw the present anticipatory bail application.

Permission is accorded.

At this stage, the learned counsel for the petitioner submits that though the vehicle from which 85.200 Kgs. of Ganja was recovered belongs to him, but then the petitioner, admittedly, was not present at the place of occurrence and he was completely unaware that the driver of the vehicle would misuse his vehicle for such illegal purpose. It is next submitted that merely because he is owner of the vehicle, the petitioner came to be implicated when no prudent man would use of

Be that as it may, the petitioner is at liberty to raise all the issue at the time when his regular bail is taken up for consideration.

Accordingly, instant petition is dismissed as withdrawn with the liberty aforesaid.
