The petitioner seeks regular bail in connection with Special Excise Case No. 468 of 2017, arising out of Maner P.S. Case No. 177 of 2017 for the offences punishable under Sections 272, 273 of the Indian Penal Code and 30 of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 1260 liters of illicit foreign liquor wine from a pick-up van and upon disclosure made by the co-accused person, namely, Sailu Kumar, the name of the petitioner had transpired during the course of investigation. The learned counsel for the petitioner submits that the petitioner has nothing to do with the said pick-up van and he is

No.63006 of 2017 (2) dt.17-01-2018 2/2 also neither the owner nor the driver of the said pick up van as well as he has been merely roped in the present case upon disclosure made by the co-accused who has already been granted bail. The petitioner has a clean antecedent and he is in custody since 7.11.2017..

Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. Excise No. 468 of 2017, arising out of Maner P.S. Case No. 177 of 2017.
