Petitioner seeks bail in a case registered for the offences punishable under Sections 20 and 22 of the NDPS Act. From beneath, a seat of the bus 15 Kg of Ganja was recovered. The petitioner was a passenger on the said public bus, hence suspicion is that the recovered Narcotic Ganja belonged to the petitioner. Petitioner has stated on oath that he has got no criminal antecedent and the case diary would also reveal that the petitioner has got no criminal antecedent. Considering the aforesaid facts as well as the fact that only suspicion is there, which is not strong one and the fact that the petitioner was travelling on a public bus, let the

No.55903 of 2017 (3) dt.04-01-2018 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with NDPS Case No.10 of 2017 arising out of Mashrakh P.S.Case No. 151 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
