2. The petitioner seeks bail in connection with Govindpur P.S. Case No. 8 of 2025 instituted for the offences under Sections 303(2), 317(2), 318(4), 3(5) of the BNS.
3. The allegation against the accused persons is of repeatedly transporting stone chips using the same challans.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case only on the basis of suspicion. Learned counsel further submitted that it is evident from the FIR itself that the whole prosecution story is purely based on suspicion. Learned counsel further submitted that petitioner is alleged to be the driver of the truck in question. Learned counsel further submitted that petitioner is innocent and
Patna High Court CR. MISC. No.18215 of 2025(4) dt.17-06-2025 2/2 has committed no offence as alleged in the FIR. It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.01.2025 and has no criminal antecedent. Learned counsel further submitted that the owner of the truck in question has already been granted anticipatory bail by this Court vide order dated 02.04.2025 passed in Cr. Misc. No. 17356 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Govindpur P.S. Case No. 8 of 2025.
