JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-05-2020 Heard learned counsel for the petitioner and Sri Bipin Kumar, learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Bahadurganj P.S. Case No. 80 of 2019 (Special Excise case No. 104 of 2019), registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that in course of patrolling duty, one person started fleeing, while he was chased, but he succeeded to flee away. On verification, his name was disclosed as Mangal Soren (petitioner) then his house was searched from where a plastic container containing 25 liters country made liquor recovered.

Submission is that it would appear from the F.I.R. that at the time of search and seizure, the petitioner was not

Patna High Court CR. MISC. No.15861 of 2020(2) dt.15-05-2020 2/2 found at his house. Further submission is that, in fact, petitioner is accused in Bahadurganj P.S. Case No. 20 of 2020, in similar nature, due to that reasons, the petitioner has falsely been implicated in this case. The petitioner is in custody since 28.01.2020.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-II-cum-Special Judge (Excise), Kishanganj in connection with Bahadurganj P.S. Case No. 80 of 2019 (Special Excise Case No. 104 of 2019). (Rajendra Kumar Mishra, J) manish/- U T
