2. In terms of the earlier order of the Court dated 09.11.2017, a supplementary counter affidavit has been filed on behalf of the respondents. In the said, the stand is that the reason why the petitioner had moved the Court was that the authorities had reduced the benefit of his A.C.P. from the pay scale of Rs. 50008000/- to Rs. 4000-6000/-. However, in terms of the previous order and the decision of the Finance Department on the issue, the
Patna High Court CWJC No.5944 of 2016 dt.08-12-2017 2/2 authorities having reconsidered the matter have passed an order contained in Memo No. 1290 dated 06.12.2017, copy of which has been brought on record in the supplementary counter affidavit filed today, which states that the order to reduce the pay scale has been withdrawn and the benefit of 1st A.C.P. dated 09.08.1999 has been restored in the scale of Rs. 5000-8000/-.
3. Learned counsel for the State submitted that consequential order has also been issued to ensure that actual payment is made to the petitioner for which sanction order has also been sent.
4. Learned counsel for the Accountant General submitted that the moment the sanction order is received, necessary authority shall also be issued.
5. In view thereof, the writ petition stands disposed off with a direction to the Accountant General to ensure that within 10 days of receiving the sanction order, authority slip shall be issued, if already not done. Thereafter, the authorities concerned shall ensure that actual payment is also made to the petitioner without any delay. (Ahsanuddin Amanullah, J.) P. Kumar AFR/NAFR U
