1. Heard learned Counsel for the petitioner and learned Counsel for the State.

2. The grievance of the petitioner is that the land of the petitioner was acquired for the purpose of widening/strengthening of N. H. No. 119D by the National Highways Authority of India, having Khesra Nos. 2438 and 2440, in mouza Moinddinpur Rajwa, having an area of 0.0243 hectares and 0.0567 hectares, respectively.

3. Learned Counsel for the petitioner submits that the petitioner has not been paid adequate compensation and the nature of the land acquired by the respondents had wrongly been categorized as agricultural land instead of residential land.

4. Aggrieved by the same, the petitioner has filed Arbitration Case No. 90 of 2022 before the Divisional Commissioner -cum- Arbitrator, Darbhanga Division, Darbhanga, on 23.02.2022. Since then, three years have passed, but no steps have been taken by the respondent authorities to dispose the arbitration case, in question.

5. Learned Counsel for the State submits that the Arbitrator may be directed to dispose the arbitration case expeditiously.

Having considered the nature of dispute and the fact that the arbitration case is pending before the Divisional Commissioner -cum- Arbitrator, Darbhanga Division, Darbhanga-respondent no. 3, I feel it expedient to direct the Divisional Commissioner -cum- Arbitrator, Darbhanga Division, Darbhanga-respondent no. 3 to dispose the arbitration case filed by the petitioner after giving opportunity of hearing to all concern and by a

7. With the aforesaid observation and direction, this writ application is disposed.
