====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 23-12-2021 Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner seeks bail in connection with Mahnar P.S. Case no. 219 of 2020 registered for the offence punishable under sections 302, 201, 364/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is in custody since 29.1.2021, is person with clean antecedent and charge sheet has been submitted. Learned counsel further submits that the informant in the FIR alleges that on 19.7.2020 when his mother was sitting on her door all alone four accused persons riding on two motorcycles came and his mother recognized Aman Kumar @ Saalu
Patna High Court CR. MISC. No. 29894 of 2021(3) dt.23-12-2021 2/3 Singh who came and asked about Soni Parveen, sister of the informant. It is next alleged that when father of Aman was contacted, he assured that girl would return but when girl did not return till 8 p.m. then mother had given an application but came to know that Saalu Singh along with three unknown persons had killed Soni Parveen and had thrown her dead body. Learned counsel submits that the informant subsequently became an accused in the case and during course of investigation, it came that it was a case of honour killing. Learned counsel submits that as far as this petitioner is concerned as such he has no role to play except the fact that he is distantly related with the informant and as such in para 56 of the case diary, it has come that this petitioner has also interference in the house of the informant and based on such information that the petitioner might have killed the deceased.
Learned APP opposes the prayer for bail.
Considering the facts that petitioner is in jail custody, is person with clean antecedent, charge sheet has been submitted and his name transpired in the confession, the petitioner is directed to be released on bail on furnishing
Patna High Court CR. MISC. No. 29894 of 2021(3) dt.23-12-2021 3/3 bail bonds of Rs 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Mahnar P.S. Case no. 219 of 2020.
