The petitioner seeks regular bail in connection with Saharsa Sadar P.S. Case No. 1128 of 2017 instituted for the offences under Section 37(b) of the Bihar Prohibition and Excise Act, 2016.
The allegation against the petitioner is regarding him being apprehended in a drunken condition.
The learned counsel for the petitioner submits that the petitioner is innocent, he has a fair antecedent barring one case in which he is on bail. It is submitted that the petitioner is in custody 27.10.2017.
Considering the nature of accusation and the period of custody already undergone, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of
Patna High Court Cr.Misc. No.63368 of 2017 (2) dt.17-01-2018 2/2 Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Saharsa in connection with Saharsa P.S. Case No. 1128 of 2017.
