JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 11-09-2020 This case has been heard through video-conferencing. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 379, 406, 420/34 of the Indian Penal Code.
Prosecution case as lodged by the informant is that his daughter appeared in NEET Examination, 2017 and her All India Rank was 473173, hence, she could not be admitted in good college. In the meantime, his friend Sanjay Kumar said that one Satyajit get admission in good college with some donation and took him to his flat and introduced him to Satyajit who assured that he will get admission in Heritage Institute of
Patna High Court CR. MISC. No.16811 of 2020(3) dt.11-09-2020 2/3 Medical Science, Banaras and consequently received Rs. 16,00,000/- as donation and fee for one year on different dates in between 11.08.2017 to 29.11.2018 by cash and in the bank account and also took original certificates, marks sheet and admit card of 12th, 10th. However, the accused persons are neither returning his money nor returning his certificates and have left their house. The accused person some time took him to Gorakhpur and Jhansi and he has kept photo copy of the ticket. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case.
He submits that the informant is a land broker and informant came in contact with the petitioner through accused Sanjay Kumar and after negotiation assured him to provide two Katha of land in Janipur (Phulwari Sarif) area and for that the informant received Rs. 10,00,000/- from the petitioner subsequently refused to provide the said land and when the petitioner demanded the said amount then the informant returned about seven lakhs through his account and uptil now did not return the entire amount and when the petitioner stated that he would file case for refund of the entire amount then this false case with false allegations has been cooked up as after thought with a view to grab the rest amount of the petitioner.
Patna High Court CR. MISC. No.16811 of 2020(3) dt.11-09-2020 3/3 informant alleged that he had paid the alleged amount till 29.11.2018. It is submitted that last date for admission in MBBS Course in Medical College is September, 30 for session 2017-18 and it is highly surprisingly that the informant had paid the alleged amount till 29.11.2018 when admission in MBBS Courses in Medical College for Session 2017-18 was over. He further submits that no such occurrence as alleged has ever taken place and this false case with false allegations has been cooked up after suppressing the entire true facts with a view to harass and humiliate the petitioner.
In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 3rd Patna in connection with Beur Police Station Case No. 431 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
