The petitioner is languishing in custody since 02.01.2019 in a case registered for the offences punishable under Sections 147, 148, 149, 447, 337, 341, 323, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case is that on 26.08.2017 at 8.30 P.M. the informant and his family members went to attend feast in the house of Sushil Singh, in the meantime, co-accused Babu Saheb Singh in inebriated condition started abusing the informant and his brother, Santosh Singh for falsely implicating

No.20064 of 2019(2) dt.02-04-2019 2/3 the petitioner in a case, thereafter, when the informant, brother and nephew were returning home, the petitioner, Nagmani Singh @ Mithu along with other co-accused persons came at the door of the informant and started abusing and thereupon the informant and his family members raised alarm when the petitioner fired on the brother of the informant causing injury on his thigh. It is alleged that co-accused Himanshu Singh caused injury on the head of the brother of the informant, Vishesh Singh by pelting stones.
It is submitted by learned counsel for the petitioner that there is no accusation of repeating the blow. The injury has been caused on non-vital part of body and investigation has already been concluded.
Learned counsel for the informant submits that there is specific accusation against the petitioner to have caused firearm injury to the brother of the informant and petitioner is having serious criminal antecedent.
Considering the fact that there is no accusation of repeating the blow and investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned
