JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The petitioner, who is in custody since 27.01.2020 and is a person of clean antecedents seeks bail in connection with Rajepur P. S. Case No. 61 of 2019 dated 25.05.2019 instituted for the offences under Sections 272, 273, 414/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears that out of four persons, two were apprehended on chase, viz, Arjun Kumar and Binay Kumar. They are alleged to have named the petitioner as one of their accomplices.

It further appears that 114.795 litres of liquor

The learned counsel for the petitioner submits that the name of the petitioner has transpired on the confession of an arrested accused person and there has not been any recovery from his possession.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Additional Sessions Judge cum Special Judge, Excise, Motihari, East Champaran in connection with Rajepur P. S. Case No. 61 of 2019.
