JUSTICE BIRENDRA KUMAR ORAL ORDER 31-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Fesar P.S. Case No.18 of 2016, a case under Sections 302/392/411/34 of the Indian Penal Code.

The petitioner is in custody since 21.05.2016. The petitioner is said to be one of the assailant of the brother of the informant.

Earlier prayer for bail was refused by this Court on 16.01.2017 in Cr. Misc. No.52119 of 2016 with liberty to renew the prayer for bail after nine months from the date of receipt of a copy of this order by the learned trial Court and the trial Court was directed to conclude the trial within the aforesaid period. The

Patna High Court Cr.Misc. No.55103 of 2017 (4) dt.31-01-2018 P2/ report of the learned trial Judge, at Flag-C, would reveal that even charge has not been framed uptil now.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
