The petitioner seeks bail in Salimpur P.S. Case No. 209 of 2021, registered for the offence punishable under Sections 366(A), 379 of the Indian Penal Code. As per the prosecution case, this petitioner enticed away the daughter of informant and also took away gold ornaments of the informant.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. In fact, there was love affair between the victim girl and the petitioner. The victim girl in her statement under Section 164 Cr.P.C has stated that out of her own will she went along with this petitioner and they also solemnized marriage in Kolkata. They are living as husband and wife. The victim girl has disclosed her age to be 18

Patna High Court CR. MISC. No.19085 of 2022(2) dt.26-05-2022 2/2 years. Petitioner is in custody since 29.12.2021 and has got no criminal antecedent. Chargesheet has already been submitted. In view of the statement of victim girl under Section 164 Cr.P.C, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Barh, Patna in connection with Salimpur P.S.
