Petitioner, already in custody, seeks bail in connection with Agiaon Bazar P.S. Case No.75 of 2016, giving rise to Sessions Trial No.161 of 2017, registered under Sections 147, 148, 149, 341, 323, 307, 504, 120(B) and 302 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Allegation in brief is that this petitioner on exhortation of other co-accused shot at informant's father on his chest as a result he succumbed to the injury.
Learned counsel for the petitioner submits that this case was lodged after delay of three days and in the case diary some of the witnesses have stated that it was Raju who shot at the
Patna High Court Cr.Misc. No.2458 of 2018(5) dt.20-02-2018 2/2 deceased and the petitioner is in custody since 02.01.2017. Learned counsel for the State submits that there is specific allegation against the petitioner in the FIR itself. He shot at the informant's father causing his death. The injured was referred from Ara to PMCH, therefore, delay is caused. Having considered the said facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Agiaon Bazar P.S. Case No.75 of 2016, giving rise to Sessions Trial No.161 of 2017, pending in the court of learned 4th Additional Sessions Judge, Ara, Bhojpur.
