The appellants is apprehending his arrest in connection with Karagahar (Sidhui) P.S.Case No.355 of 2018 (Registered Case No.275 of 2018) , registered for offences punishable under Sections 341, 323, 379, 354, 504 of the Indian Penal Code and Section 3(1)(r)(s)(w) II of SC/ST (Prevention of Atrocities) Act. Allegation against the appellant is of trying to outrage the modesty of the informant and abusing her also.
Submission of the learned counsel for the appellant is that the whole case is false and concocted and considering the same, the appellant was given benefit of Section 41A of the Cr.P.C. and he has not misused the same. Heard learned Special P.P.
Having heard both sides, considering the facts and circumstances of the case, this appeal is disposed of with direction to the appellant to surrender before the learned Special Judge within a period of six weeks from the date of receipt of the
Patna High Court CR. APP (SJ) No.1128 of 2019 dt.03-04-2019 2/2 order and make prayer for regular bail, which will be considered on the basis of materials available on the record as well as on the fact that he was on police bail and he has not misused the same and considering the same, the learned special judge shall try to dispose of the same if possible on the same day. Accordingly, this appeal is disposed of.
