Petitioners are apprehending their arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 323, 341, 379, 504, 506 of the Indian Penal Code. It is alleged that petitioners encroached upon the common path by putting wall and on protest being made they assaulted the informant and snatched Rs. 2000/- and gold chain.
It is submitted by learned counsel for the petitioners that petitioners had made construction on their own
Patna High Court Cr.Misc. No.31952 of 2015 (2) dt.06-08-2015 2/2 purchased land and in the background of dispute with regard to title of the part of the land the accusation has been levelled. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Patna in connection with Complaint Case No. 3920(C) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
