JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,323,332,337,353 and 431 of the Indian Penal Code and sections 3 and 4 of the Damage to Public Properti (Prevention) Act.

The prosecution case is that 500 people were protesting against the killing of one Rabindra Rai supposedly on the basis of video footage.

It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general against the mob. The video footage also does not suggest any specific overt act against the petitioner. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Supaul in connection with Supaul P.S. Case No. 191 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
