JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-04-2019 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Bihta Police Station Case No. 1213 of 2018, disclosing offences under Section 382 of the Indian Penal Code. The informant has described himself to be the Administrative Officer of S. P. Shingla Construction Pvt. Ltd., which is engaged in the construction of bridge over Sone river. He has alleged commission of theft of certain articles belonging to the said company.

Learned Counsel appearing on behalf of the

Patna High Court CR. MISC. No.20566 of 2019(2) dt.03-04-2019 2/2 petitioners has submitted that the petitioners were the dailywage mazdoors, working in the said company and they have been falsely implicated because they had not been paid wages and they were making demand for such payment. Considering the nature of allegation, this application is allowed.

Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Danapur, Patna, in connection with Bihta Police Station Case No. 1213 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
