2. The petitioner seeks regular bail in a case registered for the offence under Sections 399, 402, 411, 420 of the Indian Penal Code and Section 25(1-b)a,26/35 of the Arms Act.

3. As per the prosecution case, the petitioner was planning loot along with other criminals and was caught on the spot with one knife, two live cartridge and one stolen motorcycle.

4. Learned counsel for the petitioner submits that nothing incriminating has been recovered from the possession of the petitioner and the petitioner is in custody since 30.08.2023.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.22720 of 2024(2) dt.04-04-2024 2/2 prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-XIII, Saran at Chapra/concerned Court below in connection with Dariyapur P.S. Case No. 553 of 2023 subject to condition that:- 7(i). The petitioner will mark his attendance at the Nayagaon Police Station/local police station of the petitioner on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
