The petitioner is seeking anticipatory bail in connection with Trial No. 939 of 2018 arising out of Mahammadpur P.S. Case No. 39 of 2016 registered under Sections 387 of the Indian Penal Code.

Learned counsel for the petitioner submits that as per prosecution version that one Rahul Kumar alleging that he has received a message in his mobile asking him to deposit Rs. 20 lakhs in his account which belongs to the petitioner. It is submitted that petitioner has been falsely implicated in the present case and he has nothing to do with the alleged occurrence. However, he has no criminal antecedent. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

No.18283 of 2019(2) dt.04-04-2019 2/2 Considering the facts and circumstances of the case whereunder the informant had received a message on his mobile from a particular number which does not belong to the petitioner asking him to deposit Rs. 20 lakhs in the account of the petitioner but in fact no money has been deposited in the account of this petitioner as also that petitioner has no criminal antecedent, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - I, Gopalganj, in connection with Trial No. 939 of 2018 arising out of Mahammadpur P.S. Case No. 39 of 2016, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
