JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-06-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Dumariyaghat P.S. Case No. 92 of 2015 for the offence under Sections 395 and 412 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 19.12.2019.

Learned counsel for the petitioner would submit that the petitioner was not named in the FIR and nothing has been recovered from his possession. Learned counsel further submits that similarly circumstanced accused persons, namely, Ranjeet Kumar and Pradeep Kumar Yadav have been granted bail by the

Patna High Court CR. MISC. No. 17536 of 2020(2) dt.02-06-2020 2/2 coordinate Benches of this Court in Cr. Misc. No. 11633 of 2016 and Cr. Misc. No. 62304 of 2017, respectively. Considering the fact that other accused persons have been granted bail and the petitioner has no criminal antecedents and nothing has been recovered from his possession, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Chamaparan in connection with Dumariyaghat P.S. Case No. 92 of 2015, subject to the condition that on release, the petitioner shall render his service as volunteer in the District Health Centre for a period of three months in dedicated Covid hospital. He is required to report the District Nodal Officer in the concerned region who shall utilise the service of the petitioner appropriately.
