JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Barhara (Sinha O.P.) P.S. Case No. 200 of 2019, registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that it would appear from the FIR that on the basis of Fradebyan of informant, Munna Rai, Barhara (Sinha O.P.) P.S. Case No. 200 of 2019 was instituted on 10.06.2019 against five unknown but in course of investigation, one Krishna Kumar Pathak @ Rithik Pathak was apprehended with loaded Tractor and thereafter, the name of the petitioner and others have surfaced in the confessional statement of co-accused, Krishna Kumar Pathak,

Patna High Court CR. MISC. No.16093 of 2020(2) dt.05-06-2020 2/2 except that nothing has been collected by the Investigating Officer showing the involvement of the petitioner in the present case. It is further submitted that petitioner has no criminal antecedent and is in custody since 04.01.2020 and after investigation, charge sheet has already been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Barhara (Sinha O.P.) P.S. Case No. 200 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
