The petitioner seeks bail in Mairwa P.S. Case No.113 of 2019 registered under Section 414 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act. The police on secret information raided the house of Vishal Singh. One white colour Bolero and three motorcycles were parked near the house of Vishal singh. Three persons namely, Ravi Singh, Vishal Singh and Manish Kumar were apprehended and on search, 36 liters of Indian made foreign liquor was recovered. Petitioner was not apprehended on the spot.

The learned counsel for the petitioner submits that the apprehended accused disclosed the name of the petitioner. One of the motorcycles belonged to the petitioner and petitioner had

No.16231 of 2020(2) dt.13-05-2020 2/2 gone to the house of Vishal Singh but nothing has been recovered from the possession of the petitioner or no incriminating article was recovered from the motorcycle of the petitioner. Petitioner is in jail since 22.02.2020 as he was remanded in Darauli P.S. Case No.15 of 2020.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge(Excise), Siwan in connection with Mairwa P.S.
