The petitioner seeks bail in a case registered under Section393 of the Indian Penal Code was also added. The prosecution case, in brief, is that a dead body was found lying on the road on account of accident at Belwa Harpur Village. It has been submitted on behalf of the petitioner that the petitioner is in custody since 19-03-2018 and there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused in this case due to mistake of fact. Charge sheet has already been submitted in this case. A hot exchange of words had taken place between the petitioner and the informant and the present case has been instituted with intention to
Patna High Court Cr.Misc. No.50240 of 2018 (2) dt.14-09-2018 falsely implicate the petitioner. It is further submitted that the petitioner may be released after completion of nine months in custody.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, it is directed that on competition of nine months in judicial custody in this case, the petitioner, above named, will be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri V.K. Mehta, learned Judicial Magistrate-Ist Class/concerned court, Jhanjharpur in connection with Laukaha P.S. Case No. 70 of 2018.
