The petitioner seeks bail in a case initially registered under Sections- 307/34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case, in brief, is that accused persons having intercepted the informant, fired upon him.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 05-04-2018 and he has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge sheet has already been submitted in this case. The petitioner is not named in the FIR. His name has come in this case in course of investigation in confessional statement of co-accused. There is no other substantial
Patna High Court Cr.Misc. No.50287 of 2018 (2) dt.14-09-2018 evidence to suggest the implication of the petitioner in the present case. The other similarly situated co-accused namely, Nitish Kumar Sah has been granted bail by a coordinate bench of this court vide order dated 07-08-2018 passed in Cr. Misc. No. 48669 of 2018.
On behalf of the State, it is submitted that the petitioner's name has come in course of investigation.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IIIrd, Jhanjharpur, Madhubani in connection with Khutauna P.S. Case No. 32 of 2018.
