The petitioners being mother, unmarried sister and brother of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324 and 304B/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant after one year of marriage for non-fulfillment of dowry demands. The informant along with his cousin Mukesh Mahto went to the in law's house of his daughter. Seeing the dead body of his daughter the informant proceeded to inform the police when the co-accused Jitendra Mahto, Nagendra, Bhajji Mahto and others being co-villagers of the husband of the victim made
Patna High Court Cr.Misc. No.31026 of 2015 (2) dt.04-08-2015 2/2 assault to the informant. Specific accusation of assault with knife is against co-accused Bhajji Mahto.
It is submitted by learned counsel for the petitioners that the petitioners claim to be separate from the husband of the victim and husband of the victim is in custody. He further submits that the accusation is omnibus and general against all the family members.
Considering the thrust of accusation against the husband of the victim, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Mashrak P.S. Case No.236 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
