The petitioner, who is in custody, seeks bail in connection with Pirbahore P.S. Case No. 603 of 2017 registered for the offence punishable under Sections 290 of the Indian Penal Code and Section 20/22 of Narcotic Drugs and Psychotropic Substances Act, 1985.
The allegation against the petitioner is of recovery of 5 gram smack, which come under small quantity, cash, mobile and one Chilam.
Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case and nothing has been recovered from his possession. It has further been submitted that petitioner runs business of Kirana General
Patna High Court Cr.Misc. No.1713 of 2018(3) dt.07-02-2018 2/2 Store who went to purchase some items from whole sale Mandi where he was taking tea in the shop and was caught merely on suspicion. It has been further submitted that he has no criminal antecedent and he is in custody since 22.10.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, Patna, in connection with Pirbahore P.S. Case No. 603 of 2017.
