ANJANA MISHRA ORAL ORDER 25-02-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Hasanpur P.S. Case No.54 of 2015 for allegedly having committed the offence under Sections 420, 467, 468, 471 and 120B/34 of the Indian Penal Code.

Case diary in the case was called for, which has since been received.

Learned counsel for the petitioner submits that the entire allegation against the petitioner is false and frivolous and only because he had introduced one Bhola Mahto at the time of opening of Bank account, that his name was drawn into the present case. It is further submitted that whatever may have been the offence, the petitioner is not at all connected with the

Patna High Court Cr.Misc. No.30802 of 2015 (3) dt.25-02-2016 2/2 discharge and disbursement of any amount of money meant for Indira Aawas Scheme. It is further submitted that there is no specific allegation against the petitioner.

Learned counsel appearing on behalf of the State after perusal of the case diary submits that it was the Panchayat Sachiv and the Branch Manager who had released the money and not this petitioner. It is further submitted that there is no further cogent material in the case diary so as to connect the present petitioner.

Considering the aforementioned facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri D.K. Bhaksar, learned Judicial Magistrate, 1st Class, Rosera, District-Samastipur, in connection with Hasanpur P.S. Case No.54 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
