Mr. Ashhar Mustafa learned counsel for the respondent Tilka Manjhi, Bhagalpur University and learned counsel for the State is present.

On the last occasion, when the matter was taken up on 04.11.2022, none had present to represent the case of the petitioner. Today, is the same position.

A counter affidavit has been filed on behalf of the respondent Tilka Manjhi, Bhagalpur University and by referring to the averments made in the counter affidavit, it is submitted that

Patna High Court CWJC No.8869 of 2021 dt.12-12-2022 2/2 during the pendency of this writ application, substantive grievance of the petitioner has been redressed, however, the arrears of pension due from 01.04.2017 to March 2019 would be disbursed as soon as grant is received from the State. He further submits that so far as the arrears of difference of pension amount for the period April 2019 to April 2020 is concerned, the same will be paid to the petitioner within a fortnight.

In view of the averments made in the counter affidavit, the present writ application stands disposed of with a direction to the respondent authorities of Tilka Manjhi, Bhagalpur University to ensure the payment of arrears of pension for the period 01.04.2017 to March 2019 as well as April 2019 to April 2020, as early as possible, preferably within a period of eight weeks from today. It is needless to say that the petitioner is aged about 87 years, hence, any latches on the part of the respondent authority shall be viewed seriously.
