2. The petitioner apprehends his arrest in a case registered for the offence under Sections 48(A), 304(B) of the Indian Penal Code and Section 3, 4 of the Dowry Prohibition Act.

3. It is alleged that this petitioner alongwith other coaccused persons committed the murder of sister of informant for dowry.

4. It is submitted on behalf of petitioner that petitioner is husband of the deceased and has been made accused in this case merely on suspicion. Being husband of the deceased, the petitioner neither demanded any dowry nor committed tortured

Patna High Court CR. MISC. No.19020 of 2023(4) dt.19-08-2023 2/2 to the deceased. In fact, sister of the informant died due to electric shock. It is lastly submitted that during course of the investigation, none of the witnesses have supported the prosecution case.

However, learned A.P.P. for the State vehemently opposed the prayer for pre-arrest bail and submitted that petitioner is husband of the deceased and there is specific allegation of demand of dowry against him and his family members. The deceased died within seven years of marriage at her matrimonial house in an unnatural circumstances.

6. Considering the nature and gravity of the offence and the fact that petitioner is husband of the deceased and there is specific allegation of demand of dowry, I am not inclined to extend the privilege of anticipatory bail to the petitioner and same is, accordingly, rejected.
