2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148 , 149, 341 , 323 , 332, 307, 353 , 337, 153(a) , 295(a) , 427 and 298 of the Indian Penal Code and 66 ( D ) of Information Technology Act. 3 . F.I.R., lodged on written application of PSI Vishal Anand where he alleged that on 31.07.2023 at about 8:30 PM in evening he received information that some anti-social elements assembled to disturb communal harmony and when informant along with other police official reached at the place of occurrence and tried to pacify the matter between two groups of communities then both the communities clashed and also scuffled with police party .

4. Learned counsel for the petitioner submits that there is no specific allegation of overt act against that this petitioner. Allegation is general and omnibus. Ptitioner is only alleged to be member of mob . Petitioner claims clean antecedent.
5 . Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the fact that there is no specific allegation of overt act against this petitioner, clean antecedent of this petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM XV Gopalganj in connection with Mirganj P.S. case No. 297 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
