The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341/323/307/34 of the Indian Penal Code and 27 of the Arms Act. It is alleged that petitioners and co-accused Munni Sah came to the house of the informant when co-accused Munni Sah caused fire arm injury to the son of the informant. The motive for causing injury was that the irrigation water accidentally went to the house of co-accused Munni Sah.

It is submitted by learned counsel for the petitioners that petitioners are agnates of the informant. The accusation of firing is against co-accused Munni Sah. There is no overt-act alleged against the petitioners. A statement has been made in

Patna High Court Cr.Misc. No.31029 of 2015 (2) dt.04-08-2015 2/2 paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No.150 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
