The petitioner seeks bail in a case instituted for the offences under Sections 448, 323, 325, 379, 506 and 34 of the Indian Penal Code and 8 of the POCSO Act.
Prosecution case, in short, is that minor girl of the informant was teased by the petitioner and on being complained, the informant was assaulted by him.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.4.2018. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. It is a case of eve teasing. The petitioner has been made accused due to mistake of fact. The allegations made in
Patna High Court Cr.Misc. No.50277 of 2018(2) dt.13-09-2018 2/2 the FIR is denied by the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-I, Bhagalpur in connection with Kahalgaon P.S.
