Petitioner is apprehending his arrest in connection with Begusarai Mufassil P.S. Case No. 227 of 2018 for the offences registered under Sections 323, 341, 325 and 307 of the Indian Penal Code.
Some altercation and scuffle took place between petitioner and son of the informant while playing. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. It has been further submitted that there is inordinate delay in lodging the FIR as the date of occurrence is 30.04.2018 but after 5-6 days i.e. on 05.05.2018 FIR has been lodged for that there is no
Patna High Court Cr.Misc. No.50491 of 2018(2) dt.13-09-2018 2/2 explanation. He has no criminal antecedent.
Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Mufassil P.S. Case No. 227 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
