Petitioner seeks bail in POCSO Case No.91 of 2018 arising out of Dawath P.S. Case No.181 of 2018 instituted for the offence under Section(s) 366-A/34 Indian Penal Code and Section 8 of the POCSO Act.

Counsel for the petitioner submits that the victim has given statement under Section 164 Cr.P.C., wherein, she has levelled allegation against Jawala of committing illegal act with her. Petitioner has been made accused because he is brother of Jawala.

Petitioner is in custody since 13.12.2018 having clean antecedents.

In the facts and circumstances of the case, prayer of

Patna High Court CR. MISC. No.21462 of 2019(2) dt.05-04-2019 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Rohtas at Sasaram, in connection with POCSO Case No.91 of 2018 arising out of Dawath P.S. Case No.181 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
