The petitioner seeks regular bail in connection with Special Case No. 278 of 2017 arising out of Bakhtiarpur P.S. Case No. 225 of 2017 instituted for the offences under Sections 30(a), (c) and (d) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 5.5 liters of illicit liquor and manufacturing utensils from the house of the petitioner. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. The learned counsel further submits that he is in custody since 11.11.2017 and the petitioner, barring one other case in which he has been granted bail, has a fair antecedent.

Patna High Court Cr.Misc. No.61864 of 2017 (2) dt.21-12-2017 2/2 Considering the nature of accusation and the period of custody already undergone by him, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge (Excise), Saharsa in connection with Special Case No. 278 of 2017 arising out of Bakhtiarpur P.S. Case No. 225 of 2017.
