JUSTICE PARTHA SARTHY ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has prayed for grant of regular bail in a case registered under sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, the arms and ammunitions recovered at the instance of the petitioner were used in the case Bakhtiyarpur P.S. Case no. 156 of 2021 where she is an accused.

It is submitted by learned counsel for the petitioner that Bakhtiyarpur P.S. Case no. 156 of 2021 was registered for the murder of the petitioner's husband wherein the petitioner was falsely implicated along with her nephew Vikas Kumar and alleged lover Devendra Kumar. On an alleged confessional

Patna High Court CR. MISC. No.18952 of 2022(3) dt.06-01-2023 2/2 statement made by the petitioner the arms and ammunitions were recovered. It is submitted that no such confession was made by the petitioner. No recovery has been made from the petitioner's possession. She is in custody since 14.9.2021 and investigation in the case has concluded.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration that no incriminating article has been recovered from the petitioner's possession who is in custody for 1 year 3 months since 14.9.2021 and charge-sheet has been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Bakhtiyarpur P.S. Case no. 182 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Additional Chief Judicial Magistrate-III, Barh, District Patna.
