The petitioner seeks regular bail in connection with Patori P.S. Case No. 369 of 2017 for the offences punishable under Section 30(a), 30(d), 38(1)/47 of the Bihar Prohibition and Excise Act, 2016.
The allegation is that when the police had raided the hut of the petitioner herein and one another person, 15 liter half made country wine, 20 liters country made wine, one sealed Royal stag bottle containing 375 ml. were recovered. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, he has a clean antecedent and he is in custody since 1.11.2017.

No.62867 of 2017 (2) dt.17-01-2018 2/2 Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-6th cum Special Judge (Excise), Samastipur in connection with Patori P.S.
