JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 This is an application for grant of anticipatory bail in connection with Kudra P.S. Case No. 431 of 2018, disclosing offences under Sections 406 and 420 of IPC.

Prosecution case is that informant is owner of M/s Jai Mata Vijaya Infrastructure Pvt. Ltd and running the trucks including 22 wheelers truck also. It is also alleged that informant handed over the truck to the petitioner for carrying the sand to Tengra and the petitioner has delivered the sand and taken the amount and when he came, he has not handed over the amount to the informant and fled away.

Submission of the learned counsel for the petitioner is that admittedly he is the driver of the truck and he was getting Rs.15000/- per month as salary, but he has not been paid salary for two months, and for that, he has demanded the salary, due to

Further submission is that petitioner has also lodged a complaint regarding the same before the Labour Court as well as a complaint case also. However, he has admitted that both the cases have been lodged subsequently to the present case. Further submission is that he will abide by any condition imposed upon him.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. VI, Kaimur, at Bhabhua, in connection with Kudra P.S. Case No. 431 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
