The petitioner seeks bail in connection with Farbesganj P.S. Case No. 773 of 2017 registered under Section 394 of the Indian Penal Code.

It is alleged that as per the F.I.R. two persons entered into the grocery shop of the informant and took out cash amount from the counter. He raised alarm upon which they started fleeing away. However, one of the accused, namely, Ajabul Khan was apprehended by the local people who disclosed the name of one Jumman.

It is submitted that the petitioner was neither apprehended nor any looted article has been recovered from his

Patna High Court Cr.Misc. No.62821 of 2017 (2) dt.10-01-2018 possession. His name has surfaced on confession of Jumman. Petitioner has not been put on test identification parade and he is in custody since 14.10.2017.

Considering the facts and circumstances of the case let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Araria in connection with Forbesganj P.S.
