JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-07-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
Heard the learned counsel for the petitioner and Smt. Usha Devi, the learned APP for the State. The present petition has been filed by the petitioner for modification of the order dated 25.11.2019 passed by this Court in Cr. Misc. No. 75088 of 2019 whereby and where-under the petition filed by the petitioners for grant of anticipatory bail was disposed of as having become infructuous upon the learned counsel for the petitioner having submitted that the petitioners have been arrested by the police. However, now it is the

No.18225 of 2020(2) dt.09-07-2020 2/2 submission of the learned counsel for the petitioner that only the petitioner no.1 of the said case had been arrested and on account of communication gap, he had understood that both the petitioners have been arrested. In such view of the matter it is submitted that the petitioner herein be granted liberty to file a fresh anticipatory bail petition before this Court. Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners I deem it fit and proper to dispose of the present petition with liberty to the petitioner herein i.e. Preman Ram to file a fresh petition for grant of anticipatory bail before this Hon'ble Court in connection with Bhadaur P.S. Case No. 41 of 2019.
The petition stands disposed of on the aforesaid terms and with the aforesaid liberty to the petitioner. (Mohit Kumar Shah, J) Tiwary/- U T
