Petitioner seeks bail in a case originally registered under Sections 395, 397 and later on added with Sections 412, 413 of Indian Penal Code read with Section 27 of Arms Act. It is submitted by the petitioner's counsel that though the petitioner has not been named in the first information report, he has falsely been implicated in this case. It is submitted that nothing has been recovered from his possession and that there is only one more case pending against him. Co-accused, who have been implicated with the petitioner, have been granted bail by this Court in the proceedings arising out of Cr Misc No 24630 of 2018 and Cr Misc No 24611 of 2018.

Be that as it may, considering the submissions of learned counsel for the petitioner noticed herein above, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Jokihat (Mahalgaon) Police Station Case No 376 of 2017 subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
