The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 341, 323, 304(B), 201, 379 of the Indian Penal Code.
It is a case of commission of murder of the daughter of the informant by all her in-laws family members including the petitioner for non-fulfillment of dowry demand.

The victim was not happy with the matrimonial relationship and she committed suicide. The information about the death of the victim was given to her family members and they had participated in the funeral but thereafter the police came and thereafter half-burn body was sent for postmortem report. The petitioner is in custody since 03.09.2021. A statement has been made in para 3 of the petition that petitioner has clean antecedent.
Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner and submitted that petitioner is husband of the deceased. The marriage was performed in the year 2019 and within two years, the victim was done to death. The postmortem report as well as independent witnesses also corroborates the case of the prosecution.
Considering the fact that petitioner is husband of the deceased and the deceased died within two years
Patna High Court CR. MISC. No.18639 of 2023(6) dt.25-01-2024 3/3 of the marriage, this Court is not inclined to grant the privilege of bail to the petitioner.
The prayer for grant of bail to the petitioner stands rejected.
The Trial Court is directed to expedite the trial and conclude the same at the earliest.
