The petitioners are apprehending their arrest in a case registered for the offences punishable under sections 147, 148, 149, 295(A), 296, 323, 337 and 427 of the Indian Penal Code. Accusation against the petitioners is that as soon as the procession with idol of Sarswati reached near Nagara Chauk the petitioners started pelting bricks causing injury the procisionists .
It is submitted by the learned counsel for the petitioners that accusation is omnibus and general. Petitioners have no criminal antecedent and they were at best member of the mob only. Learned counsel for the petitioners
Patna High Court Cr.Misc. No.32899 of 2015 (2) dt.11-08-2015 2/2 submits that the other accused persons have been granted anticipatory bail by this court vide Cri. Misc. No. 15570 of 2015. Considering the aforesaid facts, the above named petitioners in the vent of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M, Saran at Chapra in Khaira(Nagra) P.S. Case No. 9 of 2015, subject to the conditions as laid down under section 438(2) Cr.P.C.
