JUSTICE SUDHIR SINGH ORAL ORDER 31-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 325, 147, 149, 504, 506, 435,428 of the Indian Penal Code and Section 3(i)© SC/ST Act. The allegation against the petitioner is that he along with others brutally assaulted the informant , his brother and thereafter dragged him in their house and after tying hands and feet kept them confined therein and thereafter assaulted them in brutal manner. On hearing cry, villagers came there and then they got freed. It is further alleged that the petitioner also participated in putting the house made of straw on fire due to which 60 chickens burnt to ashes.

On behalf of the petitioner, it has been submitted

Patna High Court Cr.Misc. No.31239 of 2015 (2) dt.31-07-2015 2/2 that the petitioner has got no criminal antecedent. Further, all Sections of the Indian Penal Code are bailable except the provision of SC/ST Act. It is further submitted that place of occurrence is not a public place and the provision of SC/ST(POA)Act is not attracted.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Sherghati at Gaya, in connection with Gurua P.S.Case No. 59/2015, subject to the conditions as laid down u/s 438(2) Cr.P.C. (Sudhir Singh, J) singh/- U T
